Navigating Human Rights Law and Employment Law in the Context of Condominiums
This session will look at key considerations for condominium managers and directors to keep in mind when:
- Reviewing and responding to requests for accommodation (both with residents and employees); and
- Working with employees and contractors.
On the human rights side, this panel will discuss the basic framework for thinking about human rights issues in a condominium setting, discuss recent developments in case law and provide practical information for condominium managers and directors about what steps to take when a human rights concern arises in their community. Having knowledge of this basic framework is a great starting point to ensuring that condominium corporations are fulfilling their duties and obligations under the Human Rights Code and avoiding liability for not fulfilling same.
On the employment side, this panel will address key considerations for condominium corporations to keep in mind when employment issues arise, review key employment case law relevant to condos, and finally, it will review necessary steps that condos should take to protect themselves in the event of a breakdown in the employer-employee relationship, including ensuring employment contracts are valid and enforceable and maintaining proper documentation regarding employees.
Overall, attendees will leave with a more fulsome understanding of employment and human rights law and considerations that they should keep in mind when issues arise.
